Definitions

“Client” means any individual, group or customer who purchases Services or is provided access to, or on behalf of, an authorized group or Client, and is authorized to offer the Services to its group(s) and/or members.

“Member” means any individual that is a member (including spouse and dependents) of a Client or its customer(s).

“Company” means Benezon LLC and its Services, including The Benefits App™.

“Services” means the programs and services, including member portal and application-based tools, offered to Client and extended to Clients groups and/or Members as authorized in agreements between Company and Client.

“Engagement Tools and Programs” means flyers, videos, PPTs, email, text message, push notifications and other methods used from time to time to support member enrollment, access and usage of the Services.

“The Benefits App™” is a universal mobile application (“App”) and/or web-based portal that when configured provides access to a unique set of features, phone numbers, web sites and other information to communicate to and with end users / members.

Client Responsibilities

Client understands and confirms that The Benefits App can only provide the Services to the extent that Client(s) authorize and reasonably cooperate with us in the performance of our responsibilities herein, including the delivery, promotion and access to the services and support information necessary to provide various Engagement Tools and Programs in accordance with our Terms of Use as provided here and updated from time to time on our website(s) and/or application-based tools.

Client further acknowledges and agrees that The Benefits App, at our discretion, will make use of emails and mobile phone numbers provided by you for the purpose of notification of access to and engagement with The Benefits App. Members will retain the ability to opt out of text and email notification services at any time.

Member Responsibilities

Member understands the requirement to establish a unique and valid username and confidential password to access the Services made available by Client in accordance with our Terms of Use as provided here and updated from time to time on our website(s) and/or application-based tools.

HIPAA

The Benefits App hereby agrees to abide by and comply with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) with respect to any personal health information (PHI) received on behalf of member(s). Further, The Benefits App agrees to enter into a Business Associate Agreement, in accordance with the terms as required by the HIPPA, including statute 45 C.F.R. section 160.03. or revisions and amendments thereto. Additionally, if Client does not secure a written or oral recording of an authorization from each participant/member to draft checking or savings accounts, it is deemed to represent a failure of Client to abide by applicable laws.

Information Collection and Use

The Benefits App respects the privacy of visitors to our website and is committed to maintaining all reasonable precautions to assure the privacy and security of this web site and our apps. At times, we may ask you (as Client or Member) to provide information about yourself or your company in order to better serve you. We will only use this information to support your customer relationship with us. This information may include name, title, company, address, phone number, email address, and other relevant data. We do not require this information. We do, however, require it to download certain product information or to access specified sections of our site and apps. In both cases, this information allows us to contact you should the need arise or to respond appropriately to your request for services. The Benefits App may use this information in an aggregated form to measure number of visits, average time spent on the site, pages viewed, and other relevant statistics. The Benefits App collects this information to measure the use of our site and to improve the content of our site and programs. Our website and apps may contain “links” to other sites, and we cannot and are not responsible for maintaining your privacy once you leave our site. We attempt to only link to sites that share our high standards and respect for privacy.

We may also make use of website “cookies” to help you use our services more easily and to help us continuously improve our website and our service to you. A “cookie” is a small data file that a website can send to your browser, which may then be stored on your hard drive to help our website “remember” information about you when you return to our website, such as your preferences for our website or account id’s. Our cookies cannot read data off of your hard drive, read cookie files created by other websites or track any personal information about you. You may be able to set your browser to notify you when you receive a cookie. At your discretion, you may also periodically delete cookies on your system, but this may require re-entry of some information, such as login “remember me” features.

Registration

Some segments of our website and apps require that you be a registered user before you are granted access to those segments. During the registration process, you are required to provide contact information (such as name, company, mailing address, telephone number and e-mail address). This information will be stored in the United States and used both to contact you if necessary and to control access to restricted parts of our website and apps.

Other Data

In addition, certain on-line technical applications require the entry of technical data such as product formulations or properties. The Benefits App does not monitor nor save such information to storage devices unless the application provides for the storage of such information as a service to you. In that case, such information will not be accessed or viewed by The Benefits App personnel except for those activities required for the maintenance and upkeep of our website and apps. We will take all reasonable precautions to assure that no such information will be provided or divulged to other third party personnel.

Further, The Benefits App shall not market or advertise any products or services to you without your permission and we shall not allow any third party, or its affiliates, or partners to market any products or services to you without your permission.

Security

The Benefits App takes reasonable precautions to keep all information obtained from our online visitors secure against unauthorized access and use and we periodically review our security measures in an effort to ensure your privacy. We will not, without your permission, give, sell or provide to others for a fee any information that you provide to us, except as set forth herein. We will always ask for and obtain your permission before sharing your information with anyone other than Benezon LLC also dba The Benefits App, it’s subsidiaries and affiliates, unless we believe in good faith that the law requires our company to do so.
